Derivative Works

Derivative work License Agreement contains items that will need an agreement by fans, to the terms and conditions of their use of derivative works from our content and characters created by us in which we as the Company has an interest.

We consider derivative works to be creations by fans based on content created by us the Company.

As long as fans comply with our guidelines we will not exercise our right in regards to works that we deem as derivative works.

Characters and content created by us are protected under the Copyright Act and other applicable laws and regulations. Fans agree that we the Company retain ownership with our Characters, our content, and all alterations thereof created and provided by us.

Fans agree that any Derivative works made by them can be used by us for our purposes. Alterations or modifications of our content with no creativity we do not deem as Derivative works.

We the Company retain our sole ownership rights in regard to the use of Derivative Works of our Characters and our content.

Fans can use Derivative Works that follows all our guidelines on sharing site such as YouTube, or other relative platforms and earn monetization or advertising revenue by such sites, provided that, our guidelines, said sharing sites’ terms of use, third-party guidelines are followed and that no IP (Intellectual Properties), or copyrights, are infringed upon.

We do not allow any clips to be registered with Content ID or any automated identification system, as your own work.

FANS Agree to:

  • Not create Derivative Works that disrespects talents or works that they find unpleasant. 
  • The use of Derivative Works will be for fan-made purposes or hobby level. They agree to not make a profit in any way (including for business purposes or as an individual) off of any Derivative Works.
  • comply with all applicable laws, terms and rules on relevant platforms.
  • Not create Derivative Works that falsely represents or impersonates as official, or be mistaken as official. 
  • Not create immoral or unlawful Derivative Works and to exceed what is normally socially acceptable. 
  • Not create any Derivative Works to promote ideologies, beliefs, religions, or politics.
  • not create Derivative Works that damages our reputation, or our talents’ reputation, or damage the reputation of our content and brand.  
  • Fans agree to not create Derivative Works that damages a third party’s reputation, or violates their rights.

We value your Privacy here at Moxie’s Klubhouse LLC. We will manage all personal information we collect from you in a professional manner and carefully. We do not share any personal information that we collect from our respected users to any third party without your consent unless mandated by The United States Government, its regulatory bodies, or courts.

When visiting our website, sending emails to Moxie’s Klubhouse LLC, filling out application forms, you consent to receive electronic communications and you agree that all agreements, notices, disclosures, and other communications provided to you by us electronically satisfy any legal requirement. When you provide your information upon request, you consent to our privacy agreement and terms. You agree that the disclosure of your personal information is voluntary.

This Privacy Policy does not apply to websites that are linked to our services. We have no obligations or responsibility for data shared by external sites.

Any information that is disclosed by our services here at Moxie’s Klubhouse LLC does not reveal information that may identify individual users.

Moxie’s Klubhouse LLC does not collect information from persons under the age of 13. If you are under the age of 18 you must visit our website with the permission from a parent or guardian.

We only collect relevant information from users to improve our services and enjoyment for our users.

When necessary we may require you to provide us with personal information. We will treat your personal information with a high level of privacy and only disclose it to individuals in upper management within the agency on a need to know basis.

We collect information on our users to use in a variety of ways listed below.

  • Processing Applications, Auditions, and Interviews
  • To improve our services
  • To evaluate our decisions
  • To inform or communicate with users about updates, news, and policy changes
  • Sending users emails
  • Prevention of fraud
  • Management of contracted individuals or parties  

Information that you provide to us may be disclosed only by what is permitted and required by law, permitted by customers or consumers to perform actions that the agency believes is essential, to deliver products if a user wins a giveaway, to develop new services to improve user experience, research statistical analysis, advertising to users’ preferences. The result of statistical analysis may be disclosed to third parties but no identifiable personal information will be included in the results. When disclosing any personal identifiable information to any third party, you will be informed in writing within reasonable time not exceeding 3 days.

Inquiries regarding personal information we have collected on you can be changed at any time by the user and you may contact us to disclose any information we have on you.

You may contact us in writing by email, to request all information we have collected on you to be deleted.
